FORT LAUDERDALE – A Miramar homeowner alleges that his insurer has failed to pay benefits owed to him to cover damages to his home.

David Clark filed a complaint on May 18 in the 17th Judicial Circuit Court of Florida - Broward County against Heritage Property & Casualty Insurance Co. alleging breach of insurance policy.

According to the complaint, the plaintiff alleges that on March 4, while his property was insured under a homeowner's insurance policy, it sustained a covered loss from an accidental discharge of water from a plumbing system. The plaintiff alleges that the defendant has refused to pay the actual cash value of the insured loss. 

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages of more than $15,000 plus statutory interest, court costs and attorney's fees. He is represented by Robert A. Reynolds of Duboff Law Firm in North Miami.
