Western Construction Technologies Inc. alleges it was not paid in full for sinkhole work

ORLANDO – A Hillsborough County couple is accused of failing to pay a construction company for work performed on their property.

Western Construction Technologies Inc. filed a complaint on May 18 in the Orange Circuit Court against Albert Mendell and Nanette Mendell alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that in April 2015, Western Construction Technologies Inc. was hired by the defendants to complete remediation work caused by a sinkhole. The suit states the damage was covered under an insurance policy issued by Citizens Property Insurance Corp.

Subsequently, the suit states the plaintiff sent the check paid by the insurer to defendants' mortgagor to endorse, but instead of remitting payment to plaintiff, the defendants deposited the check into their personal checking account. Although the defendants acknowledged receipt of check, they allegedly only paid plaintiff partial payment and refused to pay the remaining balance of $5,991.98, insisting that they had already spent funds and could not pay the entire amount due and owing to plaintiff. 

The plaintiff holds Albert Mendell and Nanette Mendell responsible because the defendants allegedly breached the terms of agreement by failing and refusing to pay the full amount due to plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendants for the unpaid balance of $5,991.58, plus costs of action. It is represented by Ronald W. Sikes of Sikes Law Group PLLC in Winter Garden.
