Pedestrian files suit against Hardware & Equipment Florida after he was struck by employee

ORLANDO – An Orlando man has filed suit against an Orlando hardware store after one of its employees struck him while he was walking.

Winston and Celia Pitters filed a complaint on May 16 in the 9th Judicial Circuit Court of Florida - Orange County against Hardware & Equipment Florida Inc. and Jane Doe alleging negligence.

According to the complaint, the plaintiffs allege that on Sept. 14, 2016, Winston Pitters suffered bodily injury and resulting pain and suffering when Doe, in the course of her employment with Hardware & Equipment, struck him while he was walking across South Orange Ave. The suit states Doe fled the scene.

The plaintiffs hold Hardware & Equipment Florida Inc. and Doe responsible because Doe allegedly failed to keep an adequate and proper lookout and failed to stop or yield the right of way to pedestrians.

The plaintiffs request a trial by jury and seek judgment against defendants for compensatory damages, costs, interest and further relief as the court may deem proper. They are represented by Christopher D. Codling and Robert D. Sparks of Givens Givens Sparks PLLC in Tampa.
