Publix Super Markets shopper files suit after slipping in Hollywood store

FORT LAUDERDALE – A shopper at a Hollywood super market claims that a water leak caused her to slip and fall.

Sherry Thibault filed a complaint on May 12 in the 17th Judicial Circuit Court of Florida - Broward County against Publix Super Markets Inc. and Foodservice Refrigeration Inc. 

According to the complaint, the plaintiff alleges that on April 22, 2015, she was an invitee of Publix Super Markets Inc. and was walking along the frozen section when she fell due to a slippery substance that was allowed by the defendant to remain on the floor of their premises. As a result, plaintiff alleges she suffered bodily injury, including pain and suffering, disability, disfigurement, loss of enjoyment of life, and incurred hospital and medical expenses. 

The plaintiff holds Publix Super Markets Inc. and Foodservice Refrigeration Inc. responsible because the defendants allegedly failed to maintain the floor of the store in a reasonably safe condition, failed to warn plaintiff and other invitees of the dangerous condition of the premises, and failed to remedy or eliminate the potential danger.

The plaintiff requests a trial by jury and seeks judgment against defendants for damages and costs. She is represented by Joseph N. Nusbaum and Scott A. Leaser of Brotman Nusbaum Ibrahim in Boca Raton.
