Patient alleges doctor perforated bowel during biopsy

CLEARWATER – A patient alleges she was injured during a biopsy at Morton Plant Hospital.

Patricia Smith filed a complaint on May 9 in the 6th Judicial Circuit Court of Florida - Pinellas County against A Place for Women PA and Dr. Michelle Villar-Diaz alleging negligence.

According to the complaint, the plaintiff alleges that on July 3, 2015, she underwent a uterine biopsy by defendant Villar-Diaz and during the surgical procedure, Villar-Diaz perforated plaintiff's bowel. Plaintiff claims her condition was not diagnosed and the perforation was not treated, leading to permanent and physical injuries. 

The plaintiff holds A Place for Women PA and Villar-Diaz responsible because the defendants allegedly failed to recognize signs and symptoms of a post-operative condition that required surgical intervention and failed to either discuss further with surgeon or consult another surgeon and failed to diagnose and treat post-operative surgical infection and complication.

The plaintiff requests a trial by jury and seeks judgment for damages of more than $15,000 and any other relief to which the court deems appropriate. She is represented by Kevin Smith of Lytal, Reiter, Smith, Ivey and Fronrath in West Palm Beach.
