Property owners allege Anchor Property and Casualty Insurance breached policy

FORT LAUDERDALE – Two Hallandale Beach property owners allege their insurer wrongfully denied coverage for water damage.

Shahina & Mazhar Khan filed a complaint on April 27 in the 17th Judicial Circuit Court of Florida - Broward County against Anchor Property and Casualty Insurance Co. alleging breach of insurance policy.

According to the complaint, the plaintiffs allege that on Oct. 15, 2015, their insured property sustained a covered loss for water damage. The suit states that despite efforts of plaintiff to comply with all post-loss obligations, the defendant denied the claim on pretext that the loss was not covered by the policy. 

The plaintiffs hold Anchor Property and Casualty Insurance Co. responsible because the defendant allegedly failed to acknowledge if payment would be forthcoming, and failed to make any payment of the insurance proceeds against the terms of the policy.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages of more than $15,000, plus interest, costs and attorney's fees. They are represented by Matthew S. Weintraub of Weintraub Legal Group PA in Miami.
