Parents file wrongful death suit against respiratory therapist

CLEARWATER – The parents of a St. Petersburg child have filed a suit against a respiratory therapist alleging wrongful death.

Jessica M. Osteen and Cortez Lewis, as co-personal representatives of the estate of Aiden Lewis, filed a complaint on April 26 in the 6th Judicial Circuit Court of Florida - Pinellas County against Mishelle L. Beavens CRT alleging negligence and wrongful death.

According to the complaint, the plaintiffs allege that on Nov. 26, 2016, Aiden Lewis was transported to the Northside Hospital Emergency Department by his parents because of an anaphylactic reaction to a cashew. The suit states he was intubated and that Beavens, a respiratory therapist, began bag ventilation. The plaintiffs holds Beavens responsible because the defendant allegedly failed to monitor patient's vital signs throughout his admission, failed to call for assistance from an attending physician and failed to confirm proper placement of endotracheal tube despite signs of distress. The suit states Aiden Lewis was declared dead on Nov. 27, 2016.

The plaintiffs request a trial by jury and seek judgment against defendant for all damages recoverable under the laws. They are represented by Samuel M. Yaffa of Samuel M. Yaffa PA in Delray Beach.
