Property owner alleges United Property & Casualty breached contract in damage claim

ORLANDO – A Winter Park property owner alleges her insurer did not properly reimburse her for water damage to her home.

Jenny Rey filed a complaint on April 18 in the 9th Judicial Circuit of Florida - Orange County against United Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Feb. 6, she sustained water damage to the walls, cabinetry, baseboard, flooring and paint of her property from a plumbing failure. Although, the defendant tendered payment to the plaintiff in the amount of $6,948.78, it allegedly did not include proper reimbursement for covered losses.

The plaintiff holds United Property & Casualty Insurance Co. responsible because the defendant allegedly failed to timely evaluate and pay all benefits owed to plaintiff, and failed to comply with the terms of the insurance policy.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damage to her residence, interest on overdue payments, attorney's fees, court costs and other relief deemed just. She is represented by Rafael F. Garcia of MSPG Law Group of Central Florida PLLC in Orlando.
