Medical provider alleges Government Employees Insurance failed to pay for covered losses

Insurance 11

ORLANDO – A medical provider has filed a suit against an insurer to recover costs of medical treatment.

Advanced Physical Medicine LLC, as assignee of Brenda Vazquez, filed a complaint on April 17 in the Orange County Circuit Court against Government Employees Insurance Co. citing damages for no-fault benefits.

According to the complaint, the plaintiffs allege that on April 1, 2014, Vazquez was involved in a motor vehicle accident in which she sustained personal injuries and incurred expenses for medical care. Although, plaintiff and insured submitted properly completed health insurance claim forms, the defendant allegedly did not make payment for all of the no-fault benefits due under the policy.

The plaintiffs hold Government Employees Insurance Co. responsible because the defendant allegedly failed to pay to plaintiff the insured’s covered losses and failed to establish proof that it is not responsible for the payment of disputed benefits.

The plaintiffs seek judgment against defendant for personal injury protection benefits and extended medical benefits, together with prejudgment interest, costs and attorney’s fees. They are represented by Theophilos Poulopoulos of Schiller, Kessler & Gomez PLC in Fort Lauderdale.
