Law money 13

TAMPA – A delivery driver alleges a food delivery service company misclassified him as an independent contractor.

David Roberson filed a complaint individually and on behalf of all other similarly situated individuals on March 31 in the Tampa Division of the Middle District of Florida against Restaurant Delivery Developers LLC, doing business as Doorstep Delivery, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that he was employed by the defendant from 2012 to 2016. The plaintiff holds Restaurant Delivery Developers LLC responsible because the defendant allegedly failed to compensate its employees of overtime and minimum wages.

The plaintiff requests a trial by jury and seeks judgment against defendant, injunctive relief, compensatory and liquidated damages, interest, costs and other relief. He is represented by Eric Lindstrom of Egan, Lev, Lindstrom and Siwica PA in Orlando and Shannon Liss-Riordan of Lichten & Liss-Riordan PC in Boston, Massachusetts.
