Man alleges BVM The Bridges procured consumer report without proper disclosure

TAMPA – A man alleges his former employer invaded his privacy.

Todd K. Whitaker filed a complaint on behalf of himself and all others similarly situated on March 29 in the Tampa Division of the Middle District of Florida against BVM The Bridges LLC alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges that he suffered injury from defendant's wrongful conduct of procuring background reports on numerous applicants and employees without clearly informing plaintiff that a consumer report may be procured for employment purposes. The plaintiff holds BVM The Bridges LLC responsible because the defendant allegedly invaded plaintiff's rights to privacy and procured consumer reports without proper disclosure and written authorization.

The plaintiff requests a trial by jury and seeks judgment against defendant, determine collective action, designate class representative and counsel, statutory and punitive damages, attorneys' fees, costs and further relief as the court may deem just. He is represented by Luis A. Cabassa and Christopher J. Saba of Wenzel Fenton Cabassa PA in Tampa.
