Tropical Beach Cafe Corp. alleged to have violated ADA regulations

MIAMI – A man is seeking an order for a Miami Beach restaurant to remove physical barriers he alleges restricts access to the disabled.

Daniel Lopez filed a complaint on March 21 in the U.S. District Court for the Southern District of Florida against Tropical Beach Cafe Corp. alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he could not access the defendant's facility because he uses a wheelchair and the property has physical barriers that restrict his access. The plaintiff holds Tropical Beach Cafe Corp. responsible because the defendant allegedly has inaccessible dining tables, an inaccessible service counter and other barriers that violate the ADA regulations.

The plaintiff requests a trial by jury and seeks judgment in his favor, permanent injunction, remove the physical barriers, close facility until the alleged issues are resolved, attorney's fees, expert fees, costs and litigation expenses.
