MIAMI – A disabled man alleges he is unable to dine at a Miami restaurant because of the discriminatory barriers at the property.
Renzo Barberi filed a complaint on March 20 in the U.S. District Court for the Southern District of Florida against Coven Financial Corp., doing business as Jerry and Joes Pizza, and Eureka Plaza LLC alleging violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that he suffered from harm and discrimination due to the architectural barriers that exists in the property owned and controlled by the defendants, which he alleges discourage persons with disabilities like him to fully and equally access its facilities and premises. The plaintiff holds Coven Financial Corp., doing business as Jerry and Joes Pizza, and Eureka Plaza LLC responsible because the defendants allegedly failed to provide a disabled parking space, did not provide an accessible route for persons to move from the parking lot and other issues.
The plaintiff requests a trial by jury and seeks judgment against the defendants, injunctive and declaratory relief, an order alter the subject facility, attorney's fees, all costs, expert fees, and other expenses of suit.
