Man alleges suit was filed against him for debt that doesn't belong to him

MIAMI – A Palm Beach County man alleges a suit was filed against him to collect a debt that does not belong to him.

Craig D. Wilson filed a complaint on March 17 in the U.S. District Court for the Southern District of Florida against Portfolio Recovery Associates LLC and Pollack and Rosen PA alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Feb. 15, 2017, the defendants served with the state court summons and complaint for an alleged delinquent debt from Webbank for a Fingerhut purchase. The plaintiff alleges he has never resided at the address listed in the account statements and has never had an account with or made any purchases from the alleged debtor.

The plaintiff holds Portfolio Recovery Associates LLC and Pollack and Rosen PA responsible because the defendants allegedly falsely represented that plaintiff was obligated for the purported debt.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, attorney's fees, litigation expenses, costs of suit, and further relief as the court deems proper. He is represented by Donald A. Yarbrough in Fort Lauderdale.
