Credit One alleged to have continued to call Homestead man after he revoked consent

MIAMI – A Homestead resident alleges he was harassed by a debt collector's frequent calls.

Sergio Espinosa filed a complaint on March 1 in the U.S. District Court for the Southern District of Florida, Miami Division against Credit One Bank NA alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that the defendant called him numerous times on his cellphone to collect an alleged debt. The plaintiff holds Credit One Bank NA responsible because the defendant allegedly kept on calling the plaintiff using an automatic telephone dialing system despite his requests to stop calling.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, interest, all legal fees and any other relief as the court deems just. He is represented by Stefan A. Alvarez and William Peerce Howard of The Consumer Protection Firm in Tampa.
