Model Row Inc. employee alleges he was not compensated at proper overtime rate

MIAMI – An employee of a South Florida business alleges he was not paid overtime wages.

Javier Ricardo Herrera Jr. filed a complaint on Feb. 26 in the U.S. District Court for the Southern District of Florida against Model Row Inc. and Robert Born alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Model Row Inc. and Born responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half.

The plaintiff requests a trial by jury and seeks damages, all legal fees and any other relief as the court deems just. He is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
