Fingerhut accused of harassing consumer with debt collection calls

ORLANDO – A Volusia County man claims he was harassed by a debt collector with its frequent calls.

Ronald Leonard filed a complaint on Jan. 25 in the U.S. District Court for the Middle District of Florida, Orlando Division against Bluestem Brands Inc., doing business as Fingerhut, alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that he was caused to suffer damages resulting from defendant's barrage of calls in its attempt to collect on alleged consumer debt. The plaintiff holds Bluestem Brands Inc. responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, contacted plaintiff without prior express consent and unlawfully utilized an automatic dialer and automated voice.

The plaintiff requests a trial by jury and seeks judgment against the defendant; statutory, punitive, actual and treble damages; costs; interest; attorney's fees; enjoinder from further violations; and other relief the court may deem just. He is represented by Jared M. Lee of Morgan & Morgan PA in Orlando.
