MIAMI – A Miami-Dade County man alleges his former Miami employer did not pay him the overtime rate for extra hours worked as a painter.
Jose Julian Barahona filed a complaint on Feb. 3 in the U.S. District Court for the Southern District of Florida, Miami Division against Reisinger Painting Inc. and Charles Gilbert Reisinger citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between 2013 and 2016, he worked for more than 40 hours a week as a painter but was not paid any overtime wages during his employment from February 2014 to October 2016. The plaintiff holds Reisinger Painting Inc. and Reisinger responsible because the defendant allegedly failed to keep track of the total hours worked by the plaintiff and did not pay him overtime at a rate of time-and-one-half.
The plaintiff requests a trial by jury and seeks double damages, all overtime wages still owing, all legal fees plus interest and any other relief as the court deems just. He is represented by Allyson Morgado of Corona Law Firm P.A. in Miami.
