GRC Landscaping II alleged to have violated labor codes regarding overtime pay

MIAMI – A man alleges his former employer never accounted for overtime when calculating paychecks.

Juan Olivares-Martinez filed a complaint on Feb. 3 in the U.S. District Court for the Southern District of Florida against GRC Landscaping II LLC and Deon Botha citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked on average of 55 hours per week without being paid any overtime compensation. The plaintiff holds GRC Landscaping II LLC and Botha responsible because the defendants allegedly failed to pay overtime premiums at a rate of time-and-one-half to the plaintiff for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks all damages, liquidated damages, interest, all legal fees and any other relief as the court deems just. He is represented by Chad Levy of Law Offices of Levy & Levy PA in Sunrise.
