Consumer alleges Comenity Bank is unlawfully contacting her

TAMPA – A Tampa consumer alleges a debt collector repeatedly contacted her regarding an account that wasn't hers.

Georgene Burgess filed a complaint on Jan. 23 in the Tampa Division of the Middle District of Florida against Comenity LLC, doing business as Comenity Bank, alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she suffered damages from receiving several collection calls from the defendant regarding an account that did not belong to her. The plaintiff holds Comenity LLC, doing business as Comenity Bank, responsible because the defendant allegedly kept on contacting the plaintiff despite her request to stop contacting her.

The plaintiff seeks statutory damages, all legal fees and any other relief as the court deems just. She is represented by W. John Gadd of W. John Gadd in Clearwater.
