TAMPA – A Pinellas County woman alleges her claim for disability benefits was unlawfully terminated.
Scherryl Masten filed a complaint on Jan. 23 in the Tampa Division of the Middle District of Florida against Aetna Life Insurance Co. alleging violation of the Employee Retirement Security Act.
According to the complaint, the plaintiff alleges that in 2013, she became disabled due to stroke and was paid disability benefits until her claim was terminated on December 2015. The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly terminated plaintiff's disability benefits despite still being disabled according to the policy.
The plaintiff seeks declaration of her rights to benefits and all legal fees. She is represented by Nancy L. Cavey of Law Offices of Nancy L. Cavey in St. Petersburg.
