Zoraida Investments claims Ark Royal Insurance wrongfully refuses to pay claim

ORLANDO – A Florida company alleges an insurer has not paid a claim it submitted for water damage.

Zoraida Investments LLC filed a complaint on Dec. 28 in the Orange County Circuit Court against Ark Royal Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on July 10, 2016, it suffered loss to an insured Padua Lane property caused by water damage due to a water line failure in the kitchen. The suit states the plaintiff immediately made claims for insurance benefits, knowing well that the policy was in full force and effect, but despite that, the defendant allegedly continues to refuse to fulfill its payment obligation under the policy.

The plaintiff holds Ark Royal Insurance Co. responsible because the defendant allegedly failed and refused to pay insurance benefits which rightfully belongs to plaintiff, and caused plaintiff to pay and retain counsel to enforce its rights under the policy.

The plaintiff requests a trial by jury and seeks judgment against the defendant, damages, costs, interest, attorney's fees and such other relief as the court deems just. It is represented by David M. Carnright of Cohen Law in Coral Gables.
