Insurer alleges woman's home was damaged by fire from Whirlpool-manufactured range

ORLANDO – An insurer is suing Whirlpool Corp. over allegations a defective range caused a fire.

Modern USA Insurance Co., as subrogee of Marly Guzman, filed a complaint on Dec. 29 in the 9th Judicial Circuit Court of Florida - Orange County against Whirlpool Corp. alleging that the manufacturer assembled and placed a defective appliance into the stream of commerce.

According to the complaint, the plaintiff alleges that on April 18, 2014, Guzman owned a cooking range manufactured by the defendant that unexpectedly caught fire and caused damage to the Guzman residence and its contents, The suit states the plaintiff paid $71,163.98 to repair its insured's residence, its fixtures and contents, and provide additional living expenses to Guzman due to the extent of the damage.

The plaintiff holds Whirlpool Corp. responsible because the defendant's appliance allegedly failed to perform as safely as an ordinary consumer would expect and subjected plaintiff's insured and her property to harm caused by a defective product.

The plaintiff requests a trial by jury and seeks judgment against the defendant, damages in the amount of $71,163.98, plus interest, court costs and all other damages and further relief to which plaintiffs are entitled as a matter of law.
