Cavalry Portfolio Services LLC accused of sending deceptive collection letter

MIAMI – A Pompano Beach consumer alleges a debt collector engaged in misleading debt collection practices.

Innocia Pierrepaul filed a complaint on Jan. 11 in the U.S. District Court for the Southern District of Florida against Cavalry Portfolio Services LLC citing the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, on Jan. 11, 2016, the plaintiff received a collection letter from the defendant regarding an alleged debt that outlined a deceptive settlement offer. The plaintiff holds Cavalry Portfolio Services LLC responsible because the defendant allegedly sent a collection letter to the plaintiff that contained misleading information regarding the alleged debt, including not informing the plaintiff that any payment made on the debt would restart the statute of limitations.

The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. The plaintiff is represented by Michael Jay Ringelheim of RC Law Group, PLLC in Hackensack, New Jersey.
