Former AWP Inc. employees seek allegedly unpaid overtime wages

TAMPA – Two former employees of a Pinellas County employer allege they worked off the clock and were not paid overtime.

Clifton Kluser and David Spencer filed a complaint on behalf of others similarly situated on Jan. 9 in the Tampa Division of the Middle District of Florida against Area Wide Protective Inc., doing business as AWP Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that Kluser and Spencer were traffic controls specialists until August 2016. The plaintiffs holds Area Wide Protective Inc., doing business as AWP Inc., responsible because the defendant allegedly failed to pay overtime compensation to the plaintiffs, failed to keep time records and had them work off the clock.

The plaintiffs request a trial by jury and seek payment of all unpaid overtime compensation at the legal rate of one-and-one-half the regular pay, liquidated damages, all legal fees and any other relief as this court deems just. They are represented by Marc R. Edelman of Morgan & Morgan P.A. in Tampa.
