Man alleges he is owed thousands for sale of Absolutely Fitting stock

ORLANDO – An individual alleges he is still owed $60,000 for a stock purchase.

Keith E. Smith filed a complaint on Dec. 27 in the 9th Judicial Circuit Court of Florida - Orange County against Jon Zimmerman and Annette M. Zimmerman alleging breach of contract.

According to the complaint, the plaintiff owed stock in Absolutely Fitting and entered into a stock sale and purchase agreement with Jon Zimmerman in December 2010 for $100,000. The suit states Ann Zimmerman was the guarantor. The plaintiff holds Jon Zimmerman and Annette M. Zimmerman responsible because the defendants allegedly breached their agreement with the plaintiff by only making two payments upon the closing of the deal and the first payment but failed to pay any additional payments. He alleges he is owed $60,000.

The plaintiff seeks damages due under the lease, all legal fees and any other relief as this court deems just. He is represented by James E. Shepherd of Forster Boughman & Lefkowitz in Maitland.
