Hot Wings LLC alleges it is owed for purchase of WingIt restaurant

ORLANDO – A restaurant operator alleges Orange County residents and a limited liability company took possession of a restaurant and did not pay for it.

Hot Wings LLC filed a complaint on Dec. 27 in the 9th Judicial Circuit Court of Florida - Orange County against Timothy Herman, Joseph Aintabi, George Fakhoury, Nancy Fakhoury and Concepts JT LLC alleging breach of agreement, unjust enrichment, conversion and other counts.

According to the complaint, the plaintiff alleges that it and the defendants entered into an agreement for the defendants to purchase the WingIt restaurant and bar in 2012. At the end of a trial, which was from Jan. 5, 2012, to Feb. 28, 2012, the suit states defendants were to pay the purchase price of $50,000. The plaintiff alleges it has not been paid.

The plaintiff holds Herman, Aintabi, George Fakhoury, Nancy Fakhoury and Concepts JT LLC responsible because the defendants allegedly breached their contractual agreement to pay the plaintiff and did not relinquish possession of the business and its assets.

The plaintiff requests a trial by jury and seeks damages in the amount of $50,000, treble damages, all legal fees and any other relief as this court deems just. It is represented by Maria A. Garcia of Mario A. Garcia, P.A. in Orlando.
