Former sales rep alleges hostile work environment at Island Kitchen & Bath of the Treasure Coast

MIAMI – A Martin County resident alleges he was subjected to a hostile work environment because of his disability and was terminated for complaining about not receiving his wages.

Sinon O'Leary filed a complaint on Dec. 23 in the U.S. District Court for the Southern District of Florida against Island Kitchen & Bath of the Treasure Coast LLC alleging violation of the Americans with Disabilities Act, the Fair Labor Standards Act and the Florida Civil Rights Act.

According to the complaint, the plaintiff alleges that he is disabled and requires the use of a wheelchair. He alleges a manager frequently made derogatory and discriminatory remarks towards him and terminated him for contacting the Florida Department of Labor and Employment Security regarding unpaid wages. The plaintiff holds Island Kitchen & Bath of the Treasure Coast LLC responsible because the defendant allegedly retaliated against the plaintiff and terminated his employment and allegedly only paid the plaintiff $146.85 for more than 80 hours of work.

The plaintiff requests a trial by jury and seeks all damages, compensatory damages, punitive damages, court costs and any other relief as this court deems just. He is represented by James D. Smith of The Ticktin Law Group PLLC in Deerfield Beach.
