Contract 01

OCALA – A Tavares consumer alleges an auto dealership failed to provide a due date for a payment in a statement.

Lacresha Caldwell filed a complaint on Dec. 19 in the U.S. District Court for the Middle District of Florida, Ocala Division against Scott's Credit Cars Inc. citing the Truth in Lending Act.

According to the complaint, the plaintiff alleges that she purchased a car from the defendant in December 2015. The plaintiff holds Scott's Credit Cars Inc. responsible because the defendant allegedly failed to disclose on the truth in lending statement the due date of an irregular payment of $265.49.

The plaintiff requests a trial by jury and seeks an amount of twice the finance charge as statutory damages, actual damages, interest, all legal fees and any other relief as the court deems just. She is represented by Alex D. Weisberg of Weisberg Consumer Law Group, PA in Cooper City.
