Consumer claims Jefferson Capital Systems unlawfully tried to collect alleged debts

MIAMI – A Miami-Dade County woman claims a debt collector had no lawful authority to send her collection letters.

Genevieve Figueroa filed a complaint on Dec. 7 in the U.S. District Court for the Southern District of Florida against Jefferson Capital Systems LLC alleging violation of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that, in 2016 she received four letters from the defendant for debts she allegedly defaulted on more than five years ago. The plaintiff holds Jefferson Capital Systems LLC responsible because the defendant allegedly attempted to collect debts that are time barred.

The plaintiff requests a trial by jury and seeks statutory and actual damages, injunction against the defendant, all legal fees and any other relief as the court deems just.
