TAMPA — Two employees are suing a St. Petersburg restaurant, alleging unpaid overtime wages and violation of workers compensation acts.
Toby Vongkultrup and Sanchai Som filed a class action complaint, individually and on behalf of all others similarly situated, Dec. 5 in U.S. District Court for the Middle District of Florida Tampa Division against
Tsunami in St. Petersburg Inc., doing business as Tsunami Japanese Steakhouse and Gary Lin,
alleging they failed to pay fair wages to the plaintiffs, violating the Fair Labor Standards Act.
According to the complaint, Vongkultrup and Som worked as hibachi chefs for more than 40 hours per week without being paid any overtime compensation by the defendants. The plaintiffs allege the defendants are in violation of FLSA.
Som and Vongkultrup seek trial by jury, unpaid back wages, all legal fees and all other relief the court deems just. They are represented by attorney Donna V. Smith of Wenzel Fenton Cabassa PA in Tampa.
