FORT PIERCE — A woman is suing Comenity LLC, d/b/a Comenity Bank, a debt collector, citing alleged violation of telephone harassment statutes.
Johnna Ehrlich filed a complaint on Dec. 2 in the U.S. District Court for the Southern District of Florida against Comenity LLC, d/b/a Comenity Bank, alleging that the debt collector called the plaintiff's cellular telephone several times in an attempt to collect an alleged debt.
According to the complaint, the plaintiff alleges that since April 2015, she suffered damages from receiving several collection calls on her cellular telephone. The plaintiff holds Comenity LLC, d/b/a Comenity Bank, responsible because the defendant allegedly used an automatic telephone dialing system to call the plaintiff.
The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, interest, all legal fees and any other relief as this court deems just. She is represented by William Peerce Howard and Amanda J. Allen of The Consumer Protection Firm, PLLC in Tampa.
