Orange County man claims Reliance Standard Life wrongfully denied benefits

ORLANDO – An Orange County man alleges his claim for disability benefits was wrongfully denied.

Kia Kaviani filed a complaint on Nov. 25 in the U.S. District Court for the Middle District of Florida, Orlando Division against Reliance Standard Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in August 2015, he was forced to discontinue working due to his disabling condition as a result of a vehicle accident and cervical spine injury. He alleges the defendant denied plaintiff's claim for long-term disability benefits in March, thereby causing plaintiff to suffer monetary damages. The plaintiff holds Reliance Standard Life Insurance Co. responsible because the defendant allegedly ignored medical evidence favoring plaintiff's disability and instead relied on the views of its own medical consultants.

The plaintiff requests a trial by jury and seeks judgment against the defendant, unpaid long-term disability benefits plus interest, attorney's fees, costs of litigation and for such other relief as the court deems just. He is represented by Edward P. Dabdoub and Carter E. Meader of Wagar Dabdoub PA in Coral Gables.
