All Metro Home Care Services of Florida accused of not paying overtime

MIAMI — A former employee is suing All Metro Home Care Services of Florida Inc., d/b/a All Metro Health Care, and Dave P. Middleton, alleging violation of wage laws.

Lourdes Yanes Diaz filed a complaint on Nov. 23 in the U.S. District Court for the Southern District of Florida against the defendants, alleging that they failed to pay him fair wages.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds All Metro Home Care Services of Florida Inc., d/b/a All Metro Health Care, and Dave P. Middleton responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for hours worked that exceeded 40 per week.

The plaintiff requests a trial by jury and seeks double damages, all overtime wages still owing, all legal fees and interest, plus any other relief as this court deems just. He is represented by Allyson Morgado of Corona Law Firm, P.A. in Miami.
