Former Belfor USA Group Inc. employee alleges he was not paid overtime wages

ORLANDO – A former water technician alleges an Orange County employer did not pay overtime wages for extra hours worked and has filed a class-action suit.

Matthew Kelly filed a complaint on behalf of individually and on behalf of all those similarly situated on Oct. 31 in the U.S. District Court for the Middle District of Florida, Orlando Division against Belfor USA Group Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was employed by the defendant from December 2015 to June, but was denied his right to receive overtime wages for all hours worked in excess of 40 hours in a week. The plaintiff holds Belfor USA Group Inc. responsible because the defendant allegedly failed to compensate its employees of overtime wages, failed to properly apprise its employees of their rights under the FLSA, and failed to keep or provide an accurate record of its employees' hours worked as mandated by law.

The plaintiff requests a trial by jury and seek judgment against defendant, unpaid overtime compensation, attorneys' fees, costs and equitable relief as the court may deem appropriate. He is represented by N. Ryan Labar and Scott C. Adams of Labar & Adams PA in Orlando.
