Amica Mutual Insurance Co. accused of not providing coverage to injured pedestrian

ORLANDO – A man injured by a motorist while walking alleges his insurer has failed to make payments.

Oscar D. Guzman filed a complaint on Nov. 1 in the 9th Judicial Circuit Court of Florida - Orange County against Amica Mutual Insurance Co. alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Nov. 10, 2014, he was a pedestrian near Corporate Boulevard and Alafaya Trail in Orange County when he was struck by a vehicle driven by an underinsured motorist, causing him to suffer serious and permanent physical injuries that required medical expenses. The plaintiff alleges that at the time of the incident, he had a policy with the defendant and that the defendant refused to fulfill its monetary obligation under contract.

The plaintiff requests a trial by jury and seeks judgment for all permissible damages against defendant. He is represented by Brian C. Lamb of Martinez Manglardi PA in Orlando.
