Man claims Life Insurance Co. of North America subjected him to unreasonable claims process

TAMPA – A man has filed a suit alleging his application for disability benefits was wrongfully denied.

Aaron Wilcox filed a complaint on Oct. 18 in the Tampa Division of the Middle District of Florida against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he was covered under an employer-sponsored employee welfare benefit plan and remains to be in a disabling condition defined under the insurance policy. However the suit states that the defendant refused to pay sums due to plaintiff and has subjected plaintiff to unreasonable claims process.

The plaintiff holds Life Insurance Company of North America responsible because the defendant allegedly was influenced by its role as insurer in its decision to deny benefits while failing on its fiduciary duty as administrator to uphold plaintiff's rights to plan benefits.

The plaintiff requests a trial by jury and seeks judgment against defendant, declaration that he is entitled to premium benefits, plus interest, costs, attorney's fees and further relief as the court may deem just. He is represented by William S. Coffman Jr. of Coffman Law in Tampa.
