EMC Builders LLC did not pay overtime wages, former employee claims

MIAMI – A construction worker alleges his former employers violated wage compensation laws.

Honorio E. Solorzano filed a complaint on behalf of other similarly-situated individuals on Oct. 13 in the U.S. District Court for the Southern District of Florida, Miami Division against EMC Builders LLC, Cristobal Narvaez and Maria Fernandez citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked a minimum of 63 hours a week without being paid any overtime compensation and was not provided paystubs. The plaintiff holds EMC Builders LLC, Narvaez and Fernandez responsible because the defendants allegedly failed to pay overtime premiums at a rate of time-and-one-half to plaintiff for working more than 40 hours per week.

The plaintiff requests a trial by jury and seeks actual damages, unpaid overtime compensation plus interest, liquidated damages, all legal fees and any other relief this court deems just. He is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
