Woman alleges Travelers Property Insurance failed to pay accident claims

ORLANDO – An Orange County woman has filed a suit against an insurance company for damages after a vehicle accident.

Julia D'Arts filed a complaint on Sept. 1 in the 9th Judicial Circuit Court - Orange County against Travelers Property Insurance Co. of America alleging that the insurance company refused to grant payment according to policy.

According to the complaint, the plaintiff alleges that she was a passenger in a vehicle owned by Linder Industrial Machinery Co. and insured under a contract of insurance with the defendant. She alleges that the vehicle was struck by another vehicle operated by Dennis Shin on Oct. 22, 2012. The suit states Shin was uninsured/underinsured at the time of the accident, as a result of the incident, plaintiff suffered from physical disability, disfigurement, mental anguish, inconvenience, loss of capacity for the enjoyment of life, aggravation of a preexisting condition, expense of hospitalization, loss of ability to earn money and loss of ability to enjoy a normal life.

The plaintiff holds Travelers Property Insurance Co. of America responsible because the defendant allegedly refused and failed to pay its obligation within the insurance policy for the plaintiff's claim.

The plaintiff requests a trial by jury and seeks judgment for damages, together with interest and costs. She is represented by Paul C. Perkins Jr. of Paul & Perkins PA in Orlando.
