Discover Bank accused of telephone harassment by consumer

MIAMI – A consumer alleges a debt collector harassed him with calls made with an automatic dialing system.

Stephen Horrillo filed a complaint on Sept. 22 in the U.S. District Court for the Southern District of Florida against Discover Bank alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that he suffered damages from receiving several collection calls on his cellular telephone from the defendant in an attempt to collect an alleged debt. The plaintiff holds Discover Bank responsible because the defendant allegedly used an automatic telephone dialing system to contact plaintiff.

The plaintiff requests a trial by jury and seeks statutory damages of $1,500 for each and every violation of the TCPA, enjoin the defendant from calling plaintiff on his cellular telephone, and any other relief as the court deems just.
