MIAMI – A North Miami man claims he was damaged after a debt collector failed to report an alleged debt as disputed by the consumer.

Ralph Higgens filed a complaint on Sept. 20 in the U.S. District Court for the Southern District of Florida against Trident Asset Management LLC citing the Fair Debt Collections Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in May, he disputed an alleged debt with the defendant by mail. The plaintiff holds Trident Asset Management LLC responsible because the defendant allegedly failed to mark plaintiff's credit account or tag it as "disputed by consumer" despite receiving plaintiff's dispute letter.

The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as this court deems just. He is represented by Michael Jay Ringelheim of RC Law Group, PLLC in Hackensack, New Jersey.
