MIAMI – A delivery driver alleges he was not paid the overtime rate during his employment.

Mayer Cirto Zurita filed a complaint on behalf of all others similarly situated under 29 U.S.C. 216(b) on Sept. 21 in the U.S. District Court for the Southern District of Florida against Skyhop Global LLC and Kristine Scotto citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked an average of 60 hours per week from March 20 to Sept. 20 without being paid any overtime compensation. The plaintiff holds Skyhop Global LLC and Scotto responsible because the defendants allegedly failed to pay plaintiff any overtime premiums at a rate of time-and-one-half of his regular rate for hours worked that exceeds 40 hours.

The plaintiff requests a trial by jury and seeks double damages, all legal fees and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
