Monterey Financial Services accused of not marking alleged debt as disputed

MIAMI – A Sunrise consumer has filed suit against a debt collector over her credit report.

Clara Archibald filed a complaint on Sept. 14 in the U.S. District Court for the Southern District of Florida against Monterey Financial Services Inc. citing the Fair Debt Collections Practice Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in March, she contacted the defendant disputing an alleged debt. The plaintiff holds Monterey Financial Services Inc. responsible because the defendant allegedly did not list plaintiff's account as "disputed by consumer" on her credit report despite receiving plaintiff's dispute letter.

The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. She is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
