FORT LAUDERDALE – A cemetery maintenance worker claims he was only paid his regular rate of pay regardless of the number of hours he worked.

Sammie L. Davis filed a complaint on Sept. 9 in the U.S. District Court for the Southern District of Florida, Broward Division against Hauck Enterprises LTD citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between 2010 and 2016, he worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Hauck Enterprises LTD responsible because the defendant allegedly failed to pay plaintiff at a rate of time-and-one-half of his regular rate of pay for hours worked that exceeded 40 per week.

The plaintiff seeks unpaid overtime wages, liquidated damages, interest, all legal fees and any other relief as the court deems just. He is represented by Darren R. Newhart and J. Dennis Card Jr. of Consumer Law Organization PA in North Palm Beach.
