Ocwen Loan Servicing allegedly failed to follow federal real estate law

CLEARWATER — A consumer claims a loan company allegedly failed to abide by the Real Estate Settlement Procedures Act. 

Courtney Ott filed a complaint July 26 in the 6th Judicial Circuit of Florida, Pinella County, against Ocwen Loan Servicing LLC, alleging that the loan servicer failed to comply with the act.

According to the complaint, the plaintiff alleges that on Oct. 23, 2015, she mailed a written request for information (RFI) to the defendant who is acting as loan servicer. When an acknowledgment supposedly was not received, a follow-up notice of error letter was purportedly again sent to the defendant for not responding within the required timeframe. The plaintiff holds Ocwen Loan Servicing LLC responsible because the defendant allegedly was obligated to acknowledge receipt of the RFI, refused to comply with the borrowers' RFI and ignored its statutory duties.

The plaintiff requests a trial by jury and seeks judgment against the defendant, damages, interest, costs of suit, attorney's fees and other relief as the court deem appropriate. She is represented by Liz Cline of Korte & Wortman PA in Clearwater.
