The Prudential Insurance Co. allegedly denied woman disability payments

MIAMI — A woman has filed suit against an insurance company, claiming it allegedly denied her disability benefits for which she qualified.

Patti Nicholas filed a complaint on Aug. 25 in U.S. District Court for the Southern District of Florida against The Prudential Insurance Co. of America, alleging that the insurance firm denied the plaintiff's claim for disability benefits.

According to the complaint, the plaintiff alleges that in June 2013, she became disabled and was initially being paid disability benefits until they were stopped on Sept. 22, 2015. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly upheld its decision to deny further payment to the plaintiff's disability claim despite still being disabled, according to the terms of the plan.

The plaintiff seeks payment of disability benefits due to her, reinstatement, an order for the defendant to continue to pay disability benefits to the plaintiff for as long as she remains disabled according to the terms of the plan, all legal fees and interest, and any other relief as the court deems appropriate. She is represented by Victor Pena and Gregory Michael Dell of Attorneys Dell and Schaefer in Hollywood.
