American Recovery Systems faces class action over voice mail contents

MIAMI – A Broward County woman claims a New York debt collector engaged in deceptive practices when calling to collect an alleged debt and has filed a class-action suit.

Erica Kalkstein filed a complaint on behalf of others similarly situated on Aug. 23 in the U.S. District Court for the Southern District of Florida against American Recovery Systems LLC alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in 2016, the defendant left her two voice mails in an attempt to collect an alleged debt that did not state that the communication was from a debt collector or that the call was related to collecting a debt. The plaintiff holds American Recovery Systems LLC responsible because the defendant allegedly violated the FDCPA with the contents of these voice mails.

The plaintiff requests a trial by jury and seeks enjoin the defendant, statutory damages, actual damages, all legal fees and interest, and any other relief as the court deems just.
