Landscaping company allegedly failed to pay former employee overtime

FORT MYERS — A former employee has filed suit against a landscaper for alleged failure to pay overtime wages.

Derrick Gass filed a complaint on Aug. 19 in U.S. District Court for the Middle District of Florida against Nik's Landscaping & Maintenance Inc. and Nicholas P. Vilmanis, alleging that they failed to fairly compensate the plaintiff for all hours worked.

According to the complaint, the plaintiff alleges that between April 2013 and March 2016, he worked for more than 40 hours each week without being paid any overtime wages. The plaintiff holds Nik's Landscaping & Maintenance Inc. and Nicholas P. Vilmanis responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for hours worked that exceeds 40 hours in a workweek.

The plaintiff requests a trial by jury and seeks damages of $5,000 for the plaintiff, all legal fees and any other relief as this court deems just. He is represented by Brandon J. Hill of Wenzel Fenton Cabassa, P.A. in Tampa.
