Former employee claims business allegedly didn't pay him overtime

FORT MYERS— A former employee has filed suit against his previous employer alleging he wasn't paid overtime that was due to him. 

Termaine Claiborne filed a complaint on Aug. 19 in U.S. District Court for the Middle District of Florida against Emperors Tampa Inc., alleging that the employer failed to fairly compensate the plaintiff for overtime hours.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime wages. The plaintiff holds Emperors Tampa Inc. responsible because the defendant allegedly failed to pay the plaintiff overtime premium for hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks permanently enjoin the defendant from further violation, remedying all lost income, raises, promotions and other benefits, compensatory damages, punitive damages, reinstatement, interest, all legal fees and any other relief as the court deems appropriate.
