Trio claims Granite Source Corp. did not pay them for overtime hours worked

MIAMI — Three individuals have filed a class-action lawsuit against Granite Source Corp. and Carlos Gonzales for alleged unpaid overtime. 

Vicente Artiles, Orlando Rodriguez and Manuel V. Millan filed a complaint as individuals and on behalf of other similarly situated on Aug. 11 in U.S. District Court for the Southern District of Florida, Miami Division, against the defendants, alleging that they violated the Fair Labor Standards Act (FLSA) by not paying them for overtime hours they worked.

According to the complaint, the plaintiffs allege that they were promised a wage rate of $10 an hour or $400 weekly by the defendants, Plaintiffs Artiles and Rodriguez worked for defendant for 40 hours each week for a period of eight weeks, but claim they were not paid their wages. Plaintiff Millan worked for 31 weeks in excess of 40 hours per week, but also  claims he was not paid for all of his regular and overtime hours. 

The plaintiffs hold Granite Source Corp. and Carlos Gonzales responsible because the defendants allegedly violated the record-keeping requirements of FLSA, refused to pay the plaintiffs' minimum wages and failed to inform employees of their rights to overtime and minimum wage payments.

The plaintiffs request a trial by jury and seek judgment for the plaintiff, unpaid wages and overtime premium plus interest, double damages/liquid damages, attorneys' fees, costs of suit and further relief as the court deems appropriate.
